Indian labour law maternity provisions are made to provide working women with paid leave, medical assistance and job security during pregnancy and after childbirth. These regulations are applicable to factories, mines, plantations and most of the private establishments that have 10 or more employees. Women who comply with the eligibility regulations receive paid leave at full wages, as well as other benefits such as nursing breaks and anti-discrimination during pregnancy.

To qualify, a woman must have worked for at least 80 days in the 12 months just before her expected delivery date. This rule applies to establishments covered under the Maternity Benefit Act and not fully covered by ESIC during the maternity period.

Adoptive mothers who adopt a child below three months of age and commissioning mothers (who use surrogacy with their own egg) are also eligible. 

Where this happens, the maternity leave is calculated as of the day the child is delivered to the mother and the leave is 12 weeks.

The rule is slightly different with women who are covered under ESIC. They should have made contributions of not less than 9 months and 70 days of paid contribution in each contribution period. Once eligible, they receive cash benefits directly from ESIC.

How much maternity leave is given under Social Security Benefits?

For first-time and second-time mothers, the law allows 26 weeks of paid leave. Out of this, up to 8 weeks can be taken before delivery, and the remaining 18 weeks after childbirth. Wages are paid at the woman’s average daily salary.

If a woman already has two or more surviving children, maternity leave is limited to 12 weeks, with a maximum of 6 weeks before delivery. The law gives 6 weeks of paid leave in case of miscarriage or medical termination of pregnancy. Women who have undergone tubectomy are entitled to 2 weeks of paid leave, and pregnancy-related illness gives up to one additional month of leave.

According to government statistics, in the PMMVY scheme, maternity-related assistance has been extended to 54 lakh women in 2024-25 as compared to 22.5 lakh women in 2023-24, and India is experiencing approximately 270 lakh births annually.

What must employers do under Social Security Benefits?

Employers have clear legal duties. They must pay full wages during maternity leave and cannot terminate or dismiss a woman because of pregnancy, except in cases of proven serious misconduct. If the employer does not provide free prenatal and postnatal care, they must pay a medical bonus of ₹3,500.

Women are also entitled to two nursing breaks per day until the child is 15 months old. In the case of workplaces with 50 or more employees, a creche facility should be made available within a reasonable distance. Mothers can visit the creche four times a day with rest periods. Nonetheless, compliance has been low, with only 289 out of 628 creches in Haryana operational. Employers must display information about maternity rights, keep proper records, and inform women employees about their entitlements at the time of appointment.

The number of inspections concerning maternity compliance has been reported as 5,332 in Haryana alone since 2020, and these numbers indicate that the violation is widespread.

Women can approach the Labour Commissioner or Inspector-cum-Facilitator if their employer denies legal entitlements. Legal assistance is often required to recover unpaid dues or challenge wrongful termination.

What can women do if Social Security Benefits are denied?

If an employer delays, reduces, or refuses maternity Social Security Benefits, women have legal remedies under labour law. Complaints can be filed with the Labour Commissioner or the Inspector-cum-Facilitator for recovery of unpaid wages or violation of maternity rights. Where wrongful termination occurs during pregnancy or maternity leave, one may sue to get reinstated or compensated. In the case of women who are under ESIC, they can raise the issue directly with the ESIC authorities in case of delayed or rejected claims.
